| With
the coming into force of the Human Rights Act, this area of law has acquired
added significance. Hardly a week goes by without the Court of Appeal considering
a human rights point.
For example, in May 2001 the Court of Appeal declared that the Consumer Credit legislation is incompatible with the convention on human rights on the grounds that improperly executed agreements are unenforceable in the courts. The Judges on appeal held that this breached the right to a fair trial and also the right to respect for property and possessions. Our desire to remain generalist lawyers and not to pigeonhole your legal problem enables us to consider all aspects of your case, including human rights. Mr Tim Napier has handled a case which had gone all the way to the European Court of Human Rights in Strasbourg. Now that the Convention of Human Rights has been incorporated into English law hopefully there will no need to go that far but we welcome cases involving this aspect. |
